Controlling Access to Obscene or Harmful Materials

As directed by the Ohio Revised Code section 3375.64(C), the OPLIN Board has adopted this policy requiring each OPLIN participant to establish and enforce procedures designed to keep juveniles who use the participant's OPLIN network connection from having access to materials or performances that may be obscene or harmful to juveniles, and to keep persons who are not juveniles and who use the participant's OPLIN network connection from having access to materials or performances that may be obscene.

In the event that OPLIN receives a complaint that an OPLIN participant has not complied with this requirement, the OPLIN director shall first seek evidence that the local library board has had a chance to deal with the issue. If it appears that such efforts to resolve the complaint locally have been unsuccessful, the OPLIN director shall then immediately:

  1. contact the local library and verify that the local library board's adopted policy dealing with patron Internet access on file with OPLIN is current and is being implemented by the local library;
  2. investigate the circumstances giving rise to the complaint; and
  3. notify the involved parties of his or her findings and decision based on that investigation.

If either party is not satisfied with the director's decision, that party has the right to appeal to the OPLIN Board.
